These Terms and Conditions apply to all services provided by Rose and Ben, including the sale and hire of artificial flowers, dried flowers, and wedding floral arrangements. - By placing an order or hiring our products, you acknowledge that you have read and agree to these Terms and Conditions. All orders are subject to the availability of products. While we strive to ensure that all products listed are available, some items may be subject to stock limitations. All sales are final. Once a purchase of artificial flowers or dried flowers has been made, no returns or exchanges will be accepted unless there is a manufacturing defect. For hiring artificial flowers, an initial payment of 50% is required at the time of booking. The remaining balance must be paid 4 weeks prior to the hire period. A refundable security deposit may also be required to cover potential damages. An initial payment of 50% is required to secure a wedding floral booking. Full payment must be made 4 weeks before the wedding date. - **Accepted Payment Methods:** We accept PayPal, bank transfer and cash. Artificial Flowers** - **Rental Period:** The rental period will be specified in the booking confirmation. Late returns may incur additional charges. - **Condition of Products:** All hired flowers and decorations must be returned in the same condition as they were provided. Any damage, loss, or excessive wear and tear will result in deductions from the security deposit or additional charges for repair or replacement. - **Use of Hired Products:** Hired products are for decorative purposes only and should not be altered or damaged in any way. Any misuse of products will lead to penalties. - **Returns:** Hired products must be returned by the agreed-upon date. Failure to do so may result in additional rental fees or legal action if necessary. --- **. Wedding and Event Services** - **Consultation:** A consultation will be provided to discuss the wedding or event needs. Any specific requests should be made during this consultation. - **Changes to Orders:** Changes to wedding floral orders can be made up 4 weeks before the event, depending on availability and feasibility. After this period, no major changes will be accepted. - **Cancellations:** Cancellations must be made in writing. For wedding or event orders, cancellations made more than 12 months before the event will receive a full refund of the deposit. Cancellations made within 6 months of the event may forfeit the deposit. - **Substitution Policy:** Due to the nature of the products and the potential for supply chain issues, we reserve the right to make substitutions for floral products of equal or greater value, while maintaining the integrity of the original design. --- ### **Dried Flowers** - **Product Condition:** Dried flowers are a natural product and may vary slightly in color and shape. We take care to ensure high-quality products, but natural variations are to be expected. - **Care Instructions:** Dried flowers should be kept away from direct sunlight, moisture, and extreme heat. We are not responsible for any damage that occurs due to improper care after delivery. ---**Delivery and Collection **Delivery Fees:** Delivery fees may apply depending on the location and type of service. These fees will be communicated during the booking or ordering process. - **Delivery Times:** While we aim to deliver orders and hire items on the specified date and time, we are not liable for delays due to circumstances beyond our control, such as traffic or weather conditions. - **Collection of Hired Items:** For hire services, collection must be arranged in advance. A time and place for collection will be confirmed at the time of booking. Liability** - **Damage or Loss:** We are not responsible for any damage to the hired or purchased items once they are in your possession, nor for any injuries that may occur from misuse of the items. - **Force Majeure:** We are not liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to natural disasters, accidents, or governmental restrictions. Refunds and Exchanges** - **Sales:** All sales of artificial flowers and dried flowers are final. Refunds are only offered in cases of defective products, in which case, you must notify us within 24 hours of receiving the product. - **Hire Services:** Refunds for hire services will only be provided if the service is cancelled within 12 months before the hire period. Any cancellations after this period may result in a forfeiture of the deposit. - **Wedding and Event Services:** Refunds for wedding and event services will be handled according to the cancellation terms listed above. **9. Privacy and Data Protection** - **Personal Information:** We take your privacy seriously. Your personal information is used only for the purpose of fulfilling orders and delivering services. We will not share your information with third parties without your consent, except as required by law. - **Marketing:** With your consent, we may use your contact details for promotional purposes. You can opt out of marketing communications at any time. **10. Governing Law** - These Terms and Conditions are governed by and construed in accordance with the law, and any disputes relating to these terms will be subject to the exclusive jurisdiction of the courts **11.
